Edmonton Court of Queen’s Bench
Our client was charged with Failure to provide a breath sample into an approved screening device.
 
We took over this file only weeks before the trial date. After discussing the case with the Crown Prosecutor on the day of trial, the charges were withdrawn.

Stony Plain Provincial Court
Our client was charged with a number of offences relating to domestic violence. The Crown had proceeded by Indictment; the matter proceeded its way through the preliminary inquiry.
 
In negotiations with the Crown Prosecutor, we secured a resolution in which our client only pled guilty to one count of simple assault.
 
After hearing arguments in a sentencing hearing, the Judge agreed not to give our client a criminal record by sentencing him to a conditional discharge.

Our client was charged with impaired driving and driving over 80. Upon arrest he was denied the ability to speak with a lawyer.
 
Once we were retained we immediately requested disclosure and filed a Charter motion alleging several violations of our client’s constitutional rights.
 
The Crown initially refused to withdraw that charges and we went to trial. The Judge agreed with our argument at trial and we successfully had all criminal charges dismissed.

Edmonton Provincial Court
Our client was charged with impaired driving and driving over 80 after a 911 caller reported that he was driving erratically, speeding up to 100km/hr and then suddenly slowing down to 20km/hr. He was barefoot, unstable, and belligerent upon being pulled over by police. He was new to the country and was concerned he would be deported. He blew over 200mg, more than two times the legal limit.
 
Upon being retained we immediately sought disclosure. We noticed several violations of our client’s constitutional rights and filed a Charter motion. Two days before trial the Crown withdrew all charges against our client.
 
Successful Result: Charges Withdrawn, No Criminal Record

Police observed our client exiting the parking lot of a bar, pulling out carelessly in front of traffic and almost causing a collision. Police could smell liquor on his breath, and he told them he had been drinking. He blew over the legal limit and was charged with impaired driving and driving over 80.  
 
Once we were retained, we immediately filed a Charter motion alleging several violations of our client’s constitutional rights. We continued negotiations with the Crown and successfully had all charges withdrawn days before trial.
